1. Definitions

To facilitate understanding of these Terms, the following definitions apply:

  • "Platform" or "Service": indicates the cloud-based Monolait software and related services.
  • "Provider": Monolait S.r.l. (fictitious), with registered office at Via Roma 1, 20121 Milan.
  • "Customer": the individual, professional, or company subscribing to a plan.
  • "AI / IA": indicates the Generative Artificial Intelligence systems integrated into the Service.
  • "Output": indicates the texts or responses generated by the virtual assistant.

2. Scope of the Service

Monolait provides a SaaS (Software as a Service) solution that allows the Customer to create, configure, and manage intelligent virtual assistants. The Service includes the management dashboard, integration of advanced language models, and conversation analysis tools.

3. Account and Registration

To use Monolait, an account must be created. The Customer is responsible for:

  • Providing accurate and up-to-date information during registration.
  • Maintaining the confidentiality of their access credentials.
  • Promptly notifying the Provider of any suspected unauthorized access.
  • Privacy Obligations: As an independent data controller of the personal data of end users who use the virtual assistant on their site, the Customer is required to publish an adequate privacy notice and to manage consents where necessary. By default, Monolait provides an anonymous and cookieless tracking system for chat end users, in order to simplify the Customer's compliance with applicable regulations (GDPR).

4. Subscriptions and Payments

Access to the full functionality of Monolait is conditional upon subscribing to a plan.

  • Billing: Payments are made in advance through the secure channels indicated on the Platform.
  • Renewal: Subscriptions are automatically renewed for the same initially chosen period, unless canceled.
  • Cancellation: The Customer can cancel the automatic renewal at any time from their dashboard. Access will remain active until the end of the period already paid.

5. Artificial Intelligence

Monolait uses advanced language models (OpenAI, Google Gemini) to generate responses. The Customer acknowledges and accepts that:

  • AI may generate inaccurate or outdated information (hallucinations).
  • Monolait does not guarantee the factual correctness of every generated Output.
  • The Customer is obliged to review Outputs before any professional or public use.
  • No Training: Monolait does not use the Customer's specific data (FAQs, uploaded documents) to train its own generative models or those of third-party providers.

6. Intellectual Property

All material on the Platform (software, design, logos, algorithms) is the exclusive property of Monolait S.r.l. or its licensors. The Customer owns the data they upload (assistant knowledge) and the conversation logs.

7. Limitations of Liability

To the maximum extent permitted by law, Monolait will not be liable for:

  • Service interruptions due to force majeure or maintenance.
  • Errors or inaccuracies in responses provided by AI to end users.
  • Loss of profit or indirect damages arising from use of the Service.

8. Duration and Termination

The contract has a duration equal to the chosen subscription period. Monolait reserves the right to suspend the account in case of violation of these Terms or non-payment.

9. Applicable Law and Jurisdiction

These Terms are governed by Italian law. For any dispute relating to the interpretation or execution of the contract, the Court of Milan has exclusive jurisdiction.
